End User License Agreement (EULA)

These Terms & Conditions (“Terms”) govern your download, installation, and use of Konstruct software (the “Software”) and your use of this website. By downloading, installing, purchasing, or using the Software, you agree to be bound by these Terms. If you do not agree, do not use the Software.

Konstruct is offered by John Ewart (“we,” “us,” or “our”). Purchases may be processed through third-party payment providers such as Gumroad; their terms may also apply to your transaction.

1. License grant

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Konstruct on devices you own or control, solely for your personal or internal business purposes.

Unless otherwise stated at the time of purchase, a license is generally tied to a single user. You may not sublicense, resell, or redistribute Konstruct or license keys except as expressly permitted by us in writing.

Konstruct, including all software, visual design, documentation, trademarks, and related intellectual property, is owned by us or our licensors. These Terms do not transfer any ownership rights to you—only the limited license described above.

You retain ownership of your own code, projects, and content. Konstruct may process your local project files and related metadata to provide features you request. We do not claim ownership of your source code or project data.

4. Accounts, licenses, and third-party services

Some features may require creating an account, activating a license, or connecting third-party AI or cloud providers. You are responsible for safeguarding your credentials and for activity under your account.

Konstruct may integrate with external services (for example, model providers, analytics, or authentication). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

5. Updates and support

We may provide updates, bug fixes, or new features at our discretion. Updates may be required for continued use of certain functionality. Unless a separate written agreement states otherwise, support is provided on a reasonable-efforts basis with no guaranteed response times or uptime.

6. Fees and refunds

Pricing is displayed at the time of purchase. Applicable sales tax or VAT may be collected at checkout by our payment provider where required by law. You are responsible for any additional taxes or duties your jurisdiction imposes that are not collected at checkout. Licenses, once issued, are not refundable.

7. Disclaimer of warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that Konstruct will be uninterrupted, error-free, secure, or that AI-generated suggestions will be accurate, complete, or suitable for production use. You are solely responsible for reviewing and validating any output before relying on it.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, arising out of or related to your use of the Software, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising under these Terms will not exceed the greater of (a) the amount you paid us for Konstruct in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (USD $50), if you obtained the software without charge.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum extent permitted by law.

9. Termination

These Terms remain in effect while you use the Software. We may suspend or terminate your license if you materially breach these Terms. Upon termination, you must stop using Konstruct and destroy copies in your possession. Sections that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be posted on this page. Continued use of the Software after changes become effective constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.
